Sexual and gender minorities in contemporary India are formed in the interstices between the neoliberal, Hindutva state; transnational discourses of liberal democracy and sexual ‘rights’; as well as cosmopolitan culture and global LGBT movements. As is evident in recent court judgments and legislation, particularly since 2014, postcolonial Hindu nationalism has created cultural conditions where forms of queer gender are permissible while queer sexuality is generally unacceptable. In recent years, significant developments have focused on transgender communities, complicating activism surrounding sexual and (...) gender identities. By positing some identities as state-sanctioned acceptable citizens and others as not, certain ‘transgender’ individuals are conceptualised as bearers of rights while finding other facets of their identities discriminated against and maintained as illegal. The 2014 Supreme Court NALSA v. Union of India judgment and The Transgender Persons (Protection of Rights) Bill, 2016 passed by the Lok Sabha, alongside further judgments and legislation affecting wider LGBT communities, have kept discourses fixed on sexual and gender identities and their relationship to Indian citizenship at the forefront of discussions of gender justices and injustices in India today. Focusing on recent judicial and legislative developments, this paper examines how transgender rights are being granted in the context of the neoliberal, Hindutva state and considers which forms of transgender identity are currently being conceptualised as legitimate and authentic in such discourses, which can serve to bolster larger right-wing visions and ideologies of the nation and its citizens. It contemplates the ways in which gender ‘justices’, framed in relation to both transnational LGBT rights discourses and right-wing agendas, are conceptualised and played out on the bodies of sexual and gender minorities. This article explores sex selective abortion as a form of structural violence within the broader notion of women's ‘protection’ in contemporary India. While SSA tends to be framed more generally within ethical and choice-based frameworks around abortion access and reproductive ‘rights’, and specifically in India around preference for sons as a discriminatory, cultural, technological misogyny, this article argues that sex selective abortion in India needs to be understood as an outcome of broader systemic economic, political and social processes. The deepening (...) of neoliberal values through state policies has impacted significantly on social relations, shaping SSA as a manifestation of structural violence. State-driven policies in India reflect a neoliberal governmentality through state patriarchy that is implicit within the neoliberal developmental, governmental and capitalist paradigm of contemporary India. This article argues that SSA is structurally produced and therefore cannot be remedied through awareness-raising strategies such as beti bachao or financial inclusion as a means to ‘protect’ or ‘save the girl child’. Indeed, it is neoliberal economic forces that actively, though seemingly inadvertently, promote anti-women, sex selective abortion as a reproductive strategy, which is then disciplined through neoliberal governmentality. This highlights SSA as a form of gendered and structural, rather than discriminatory, violence. (shrink)

Examining the ethics of long-term, career involvement by physicians in global health work is vital, given growing professional interest and potential health implications for communities abroad. However, current literature remains heavily focused on ethical considerations of short-term global health training experiences. A literature review informed our development of an ethics framework centered on two perspectives: the practitioner perspective, further subdivided into extrinsic and intrinsic factors, and community perspectives, specifically that of the host community and the physician’s home community. Some physician (...) factors included cultural/linguistic differences, power imbalances, and sustainable skills/competencies. Receiving community factors included resource limitations, standard of care disparities, and community autonomy. Home community factors focused on the opportunity cost of an unavailable physician who was trained and supported by the local community. Descriptive review permitted comparison with existing short-term literature, noting similarities and differences. Our framework provides a basis for further research and critical analysis of ethical implications of career-long physician global health work. (shrink)

Advances in our understanding of appraisal processes and emotion regulation have been two of the most important contributions of research on cognition and emotion in recent decades. Interestingly, however, progress in these two areas has been less mutually informative than one might expect or desire. To help remedy this situation, we provide an integration of appraisal theory and the process model of emotion regulation by describing parallel, interacting and iterative systems for emotion generation and emotion regulation. Outputs of the emotion (...) generation system are perceived by the emotion regulation system, and emotion regulation strategies then modulate emotion by intervening at specific stages of the emotion generation system, ultimately changing appraisal dimensions. We hope that our unified perspective will encourage and guide future research at the interface of cognition and emotion. (shrink)

It is commonly thought that moral rules and principles, such as ‘Keep your promises,’ ‘Respect autonomy,’ and ‘Distribute goods according to need ,’ should play an essential role in our moral deliberation. Particularists have challenged this view by arguing that principled guidance leads us to engage in worse decision making because principled guidance is too rigid and it leads individuals to neglect or distort relevant details. However, when we examine empirical literature on the use of rules and principles in other (...) domains, we find that people can learn to use rules discriminately and that rule-based models tend to outperform even expert judgment. I argue that this evidence poses a problem for the moral particularist. If the particularist claims that we should not rely on decision-making rules when making practical decisions and it turns out that these rules help us make better decisions, then the particularists’ prescriptive account is deficient. However, if the particularist claims that we should rely on practical decision-making rules but not on moral rules, she needs to explain how practical rules are different from moral rules and why we should rely on the former but not the latter. Catharine MacKinnon has claimed that pornography is the subordination of women. Rae Langton has defended the plausibility and coherence of this claim by drawing on speech act theory. I argue that considering the role of context in speech acts poses serious problems for Langton's defence of MacKinnon. Langton's account can be altered in order to accommodate the role of context. Once this is done, however, her defence of MacKinnon no longer looks so plausible. Finally, I argue that the speech act (...) approach (adapted to account for context) offers an appealing way to make sense of disagreements over pornography; but also that this will probably not be so appealing to most proponents of the speech acts approach. It is well established that language production and comprehension are influenced by information status, for example, whether information is given, new, topical, or predictable, and many scholars suggest that an important component of information status is keeping track of what information is in common ground, and what is not. Information status affects both speakers' choices and how listeners interpret the speaker's meaning. Although there is a wealth of scholarly work on information status, there is no consensus on the mechanisms by (...) which it is used, and in fact relatively little discussion of the underlying representations and psycholinguistic mechanisms. Moreover, a major challenge to understanding information status is that its effects are notoriously variable. This study considers existing proposals about information status, focusing on two questions: how is it represented; and by what mechanisms is it used? I propose that it is important to consider whether representations and mechanisms can be classified as either explicit or emergent. Based on a review of existing evidence, I argue that information status representations are most likely emergent, but the mechanisms by which they are used are both explicit and emergent. This review provides one of the first considerations of information status processing across multiple domains. (shrink)

Many are reluctant to accept primitive modality into their fundamental picture of the world. The worry often traces to this thought: we shouldn't adopt any more primitive - that is, unexplained - notions than we need in order to explain all the features of the world, and primitive modal notions are not needed. I examine one prominent rival to modal primitivism, combinatorialism, and show that in order to account for all the modal features of the world the combinatorialist must adopt (...) two additional primitive notions. My own modal primitivist view takes as primitive the notion of incompatibility between properties or relations. I show how the non-modal notions that the combinatorialist must adopt as primitive may be analyzed using my notion. The upshot is that with respect to the number of primitive notions, my modal primitivist theory comes out ahead. (shrink)

Properties seem to play an important role in causal relations. But philosophers disagree over whether or not properties play their causal or nomic roles essentially. Causal essentialists say that they do, while quidditists deny it. This article surveys these two views, as well as views that try to find a middle ground.

ABSTRACTMany of our emotions arise in social contexts, as we interact with and learn about others. What is not yet clear, however, is how such emotions unfold when we either react to others or attempt to regulate our emotions. To address this issue, 30 healthy volunteers reacted to or reappraised positive or negative information that was paired with neutral faces. While they were doing this task, we assessed pupillary responses. We also asked participants to provide ratings of accountability and experienced (...) emotion. Findings indicated that appraised accountability increased in response to emotional information, and changes in accountability were associated with commensurate changes in valence reports and increased pupil diameter. During reappraisal, accountability and emotion decreased, but pupil diameter increased. The findings highlight the importance of accountability appraisals during the generation and regulation of emotional reactions to others, while also documenting pupillary increases during emot... This book outlines the scale and scope of ableist bias, as it manifests both institutionally and intergenerationally. Ranging across disability studies, continental philosophy, and bioethics, the philosophical questions addressed in this work confront and resist ableism as it frames our world in uninhabitable and unsustainable ways.

Actualist counterpart theory replaces David Lewis’s concrete possible worlds and individuals with ersatz worlds and individuals, but retains counterpart theory about de re modality. While intuitively attractive, this view has been rejected for two main reasons: the problem of indiscernibles and the Humphrey objection. I argue that in insisting that ersatz individuals play the same role as Lewisian individuals, actualists commit the particularist fallacy. The actualist should not require stand-ins for every Lewisian individual. Ersatz individuals should instead be construed as (...) representations of actually existing qualitative ways for individuals to be, or qualitative properties individuals can instantiate. This necessitates changes elsewhere. Non-instrumental uses of Kripke semantics and standard counterpart semantics also require stand-ins for particular non-actual individuals. I argue that the actualist should instead adopt a non-standard counterpart semantics that more clearly illuminates the role that actual properties and relations play in explaining de re possibilities and necessities. The result is an intuitive and forceful reply to both the problem of indiscernibles and the Humphrey objection. (shrink)

This paper examines the tools used to mediate intersubjectivity as a central element in Jean-Paul Sartre’s phenomenological theory of ensembles. It first presents a brief account of ordinary individuals acting in and through violent groups from the viewpoints of psychology and phenomenology. Next, using Sartre’s ontology of consciousness, the paper establishes the phenomenological structure of consciousness and intersubjectivity to explain, with recent psychological findings, how individual agents in violent groups come to deny their moral responsibility for the group’s ideology and (...) action. Finally, through Sartre’s theory of ensembles, the paper shows how collectives of individuals evolve into groups. In violent groups, instruments of terror are used to mediate intersubjective relationships, and this explains how individual perpetrators and those complicit may sense a lack of control and perceive that they have diminished moral responsibility even though they are responsible for collective violence. As Japan marks the 75th anniversary of World War II in 2020, Prime Minister Shinzo Abe did not offer a fresh apology and maintained that future generations should not have to keep apologizing for past mistakes. This paper uses the unresolved war issue of the military comfort women system as a context to discuss what it means for political apologies to be more than mere political gestures founded on political interests and discusses what it takes to facilitate forgiveness. It will (...) examine the features of a repentant wrongdoer who deserves forgiveness based on how one relates to one’s past wrongdoing in order to distinguish political apologies that are genuine from those that are mere gestures aimed at hasty reconciliation. This will be discussed through the works of Jacques Derrida and Vladimir Jankélévitch. Next, through Jankélévitch’s and Paul Ricoeur’s ideas of forgiveness, it will be discussed how matters of justice and forgiveness should be understood as well as how the history of past wrongs and injustice is necessary for a genuine apology and makes forgiveness possible. It is also a moral responsibility for both perpetrators and victims to remember history in order to achieve personal forgiveness as well as begin social and political reconciliation. (shrink)

Emotional arousal and negative affect enhance recall of central aspects of an event. However, the role of discrete emotions in selective memory processing is understudied. Undergraduates were asked to recall and rate autobiographical memories of eight emotional events. Details of each memory were rated as central or peripheral to the event. Significance of the event, vividness, reliving and other aspects of remembering were also rated for each memory. Positive affect enhanced recall of peripheral details. Furthermore, the impairment of peripheral recall (...) was greatest in memories of anger, not of fear. Reliving the experience at retrieval was negatively correlated with recall of peripheral details for some emotions (e.g., anger) but not others (e.g., fear), irrespective of similarities in affect and intensity. Within individuals, recall of peripheral details was correlated with less belief in the memory's accuracy and more likelihood to recall the memory from one's own eyes (i.e., a field perspective). Against a backdrop of non-ideal political and legal conditions, this article examines the health capability paradigm and how its principles can help determine what aspects of health care might legitimately constitute positive health care rights—and if indeed human rights are even the best approach to equitable health care provision. This article addresses the long American preoccupation with negative rights rather than positive rights in health care. Positive health care rights are an exception to the overall moral range and general thrust (...) of U.S. legal doctrine. Some positive rights to health care have arisen from U.S. Constitutional Eighth Amendment cases and federal and state laws like Medicare, Medicaid, the State Children’s Health Insurance Program, the Emergency Medical Treatment and Active Labor Act, and the Patient Protection and Affordable Care Act. In her essay collection First, Second, and Other Selves: Essays on Friendship and Personal Identity, well-known scholar of ancient philosophy Jennifer Whiting gathers her previously published essays taking Aristotle's theories on friendship as a springboard to engage with contemporary philosophical work on personal identity and moral psychology. Whiting examines three themes throughout the collection, the first being psychic contingency, or the belief that the psychological structures characteristic of human beings may in fact vary, not just from one cultural context (...) to another, but also from one individual to another. The second theme is the belief that friendship informs an understanding of the nature of the self, an idea that springs from Whiting's uncommon reading of Aristotle's writings on friendship. Specifically, Whiting explains a scenario in which a "virtuous agent" adopts a kind of impersonal attitude both towards herself and towards her "character" friends, loving both because they are virtuous; this scenario ties in with an examination of the Aristotelian concept of the ideal friend as an "other self," or a friendship that evolves from character rather than ego, as well as Whiting's meditation on whether or not a virtuous individual should have a "special" sort of concern for her own future self, distinct in kind from the concern that she has for others. The third theme is that of rational egoism, a concept that Whiting critiques, especially in the context of Aristotle's eudaimonism. The central tenet of the collection is the message that taking "ethocentric" attitudes both towards ourselves and towards our friends sheds light on the nature of personal identity and helps to combat ethnocentric and other objectionable forms of bias, a message that is becoming increasingly urgent in light of the recent deaths of Trayvon Martin and Michael Brown. This article argues that protection of the environment requires reconsidering basic liberal ideas relating to value and growth. It selects a central thinker in the liberal tradition, John Locke, as a starting point. The article first shows how Locke’s political writings at first glance might support a “possessive individualist” position that gives primacy to individuals and their rights to property in a way that blocks governmental action to protect the environment, much as some modern versions of liberalism and libertarianism maintain. (...) However, there are other aspects of Locke’s writings that undermine this position. In particular, a reconsideration of his views on private property in combination with his views on the harm principle, the common good, and future generations can support the position that an individual’s right to exploit nature is indeed limited. These elements of Locke are strengthened considerably if Locke’s view of nature is updated by reconsidering nature as composed of ecosystems and as providing ecosystem goods and services. That land should continue to produce abundantly is foundational to Locke, and the failure to protect the ecosystems that provide key services supporting this abundance harms both the property of others and the viability of society: preservation of these constitute a collective good that transcends the individual good. The protection of ecosystem services also works to protect the value of individual holdings as well as the value of land still held in common. Finally, Locke’s writing supports the view that it is the role of government to act to protect the abundance of nature, even against the wishes of an individual property owner.Article first published online: 25 Feb 2017. A presence for decades in individuals’ everyday life practices and identity formation, the Walt Disney Company has more recently also become an influential element within the "big" curriculum of public and private spaces outside of yet in proximity to formal educational institutions. _Disney, Culture, and Curriculum_ explores the myriad ways that Disney’s curricula and pedagogies manifest in public consciousness, cultural discourses, and the education system. Examining Disney’s historical development and contemporary manifestations, this book critiques and deconstructs its products and perspectives (...) while providing insight into Disney’s operations within popular culture and everyday life in the United States and beyond. The contributors engage with Disney’s curricula and pedagogies in a variety of ways, through critical analysis of Disney films, theme parks, and planned communities, how Disney has been taught and resisted both in and beyond schools, ways in which fans and consumers develop and negotiate their identities with their engagement with Disney, and how race, class, gender, sexuality, and consumerism are constructed through Disney content. Whether the food movement is most likely to transform the food system through ‘alternative’ or ‘oppositional’ initiatives has been the focus of considerable scholarly debate. Alternative initiatives are widespread but risk reinforcing the conventional food system by supporting neoliberal discourse and governance mechanisms, including localism, consumer choice, entrepreneurialism and self-help. While oppositional initiatives such as political advocacy have the potential for system-wide change, the current neoliberal political and ideological context dominant in Canada poses difficulties for initiatives that explicitly oppose the (...) conventional food system. As such, some argue that the food movement requires convergence between alternative and oppositional initiatives. In this paper, we investigate convergence using survey results from 143 food movement organizations in four Canadian provinces. Results based on cluster analysis and descriptive statistics on organizational discourse, activities and visions of sustainable food systems demonstrate convergence around neoliberal discourse and governance mechanisms. Localism and consumer education characteristics are particularly prominent, with a majority of respondents describing their organizations as ‘local’, engaging in consumer education activities, and stating the importance of consumer education activities, indicating convergence around alternative, rather than oppositional, initiatives. While convergence around these discourse and strategies may limit the transformative potential of the food system when interpreted as neoliberalisation of the movement, such a reading does not demonstrate their full potential, as survey results also indicate trends of transformative visions of change and political engagement, particularly at the municipal level. This research demonstrates that the movement can work simultaneously within, and opposed to, the conventional food system, and provides understanding of both neoliberal leanings and the politics of the possible of the food movement. John Cooper and Pierre Hadot suggest that contemporary philosophy can no longer be regarded as a way of life as it has become an academic discipline of study that is theoretical and abstract. According to them, for philosophy to be considered a way of life, it has to be able to shape one’s understanding of the world, guide how one should respond from moment to moment, and reach an existential level in defining one’s being. In this article, I discuss how (...) Jean-Paul Sartre’s existentialist philosophy is a way of life that has been overlooked by Cooper and Hadot. I show that Sartre’s existentialism presents an interconnected perspective of human existence and human development in history, is able to guide our philosophical reasoning about our everyday decisions, and offers a practical guide to living an authentic life through assuming responsibility for our life choices and engaging with our situations. Psychiatrists working with war veterans have, in recent years, constructed ‘moral injury’ as a separate manifestation of war trauma that is distinct from Post-Traumatic Stress Disorder. This paper argues that for moral degradation to occur, it necessarily involves one’s commissions or omissions that transgresses one’s personal morality, and hence, distinguishes sufferers of moral injury from PTSD sufferers who were witnesses to traumatic and morally abhorrent events. To this end, it clarifies how some of the situations surrounding moral injury are misunderstood, (...) by discussing the process of moral reasoning in the context of moral dilemmas, dirty hands, and moral blind alleys. Finally, it concludes that when we conceptualise moral injury as being caused by one’s commissions and omissions in moral dilemmas, we find that shame and guilt are situation-appropriate responses with a role to play in what ethics mean. In Archbishop Antje Jackelén's installation homily, she identifies the strength of the Church as a "global network of prayer threads." This book is an honorary and celebratory volume providing a "global network of prayerful essays" by contributors from a variety of academic disciplines to creatively engage, reflect, and illuminate the theological (...) work of Archbishop Jackelén. Prior to her tenure in the Church of Sweden as Bishop of the Diocese of Lund and now the Archbishop of the Church of Sweden, Jackelén served as professor of Systematic Theology, Director of the Zygon Center and President of European Society for the Study of Science and Religion (ESSSAT). While each essay intentionally embraces the theological and ministerial work of Jackelén during her academic tenure, they also venture into areas as diverse as climate change, media studies, human uniqueness, hermeneutics, time, ethics, Christian theological tradition and history, traumatology, politics and society. As the first diverse explication of the theological thinking of Archbishop Jackelén by her theological colleagues, this text provides scholars with an expansion of the scope of Archbishop Jackelén's theological thinking and initiates laity into the impact of Jackelén thinking that combines with grace and precision the traditions of the Church, the challenges and gifts of the sciences, and the needs and longings of society and the world.
